Terms and Conditions
General Terms and Conditions for the Hire of Winter Sports Equipment1.) Conclusion of the contract
The hire agreement is concluded between the customer making the booking (hereinafter referred to as the ‘Hirer’) and Ski-Verleih Schneider, Fichtenweg 20a, 59955 Winterberg (hereinafter referred to as ‘Ski-Verleih Schneider’), from whom the equipment is hired. The hire is subject exclusively to the following terms and conditions:
2.) Booking
The hire price must be paid in full online and can be settled via PayPal. The prices applicable are the ‘online booking prices’ shown on the Ski-Verleih Schneider website for the respective equipment or equipment category requested.
The booking becomes valid for the hirer upon online payment and receipt of the booking confirmation; for the hire shop, it becomes valid upon receipt of the booking confirmation.
3.) Cancellation Policy
Cancellation of the booking is only possible as a result of a skiing accident or other serious reasons (e.g. the death of a close relative or a travelling companion). The cancellation must be notified to Ski-Verleih Schneider in writing. No refund of the hire price will be granted if the winter sports equipment is collected late by the hirer or cannot be collected at all for any other reason. The same applies if the hirer returns the ski and/or snowboard equipment to the hire company early. Adverse weather conditions or other hindrances beyond the control of Ski-Verleih Schneider do not entitle the hirer to cancel the booking.
In the event of a skiing injury sustained by the hirer during the hire period, the following rule applies upon presentation of a medical certificate:
a) A refund of the hire price is only possible if the hired equipment is returned to the hire company immediately after the injury occurs.
b) If point a) is fulfilled, the excess rental fee paid will be refunded from the date of issue of the medical certificate to be presented. No refund is possible without a medical certificate.
c) As soon as Ski-Verleih Schneider is made aware of the incident and conditions a) and b) are met, it will immediately transfer the rental fee already paid.
4.) Collection and return of equipment
The hirer must present official photo identification (e.g. passport or driving licence) and their booking confirmation at the hire shop, and agrees to a copy being made of this document. Ski and/or snowboard equipment must be returned on the last day of the agreed hire period before the shop closes. In the event that the ski and/or snowboard equipment is used for a longer period, the difference between the actual rental period and the reserved or paid rental period will be charged at the standard local rental rates and is payable directly on site.
5.) Insurance
In the event of theft, the hirer must report the matter to the relevant police authority within 24 hours, provide verifiable evidence of the theft to Ski-Verleih Schneider without delay, and compensate for the loss.
Where damage to or destruction of the item is caused by improper use, the customer is liable for compensation.
6.) Use
The hirer is fully responsible for the hired sports equipment and must use it with due care, in accordance with its intended function and conditions of use. If the sports equipment is already defective at the time of hire, the hire shop may – provided it is unable to rectify the defect – replace the sports equipment or withdraw from the contract. Passing the sports equipment on to third parties is not permitted. The hirer must ensure that the skis are stored individually and separately from one another or kept in ski safes. Overnight, the sports equipment must be stored in a locked ski room at the accommodation or in a locked car.
7.) Data Protection
Personal data that you provide on this website will be processed and used, in accordance with the applicable national and European data protection regulations, exclusively for the purpose of processing your enquiries or online bookings. Ski-Verleih Schneider will in all circumstances maintain the confidentiality of your data and will not sell, rent out or make it available to third parties.
8.) Jurisdiction
For all legal disputes arising in connection with or relating to online bookings via Ski-Verleih Schneider, German law shall apply exclusively and the national courts in Germany shall have exclusive jurisdiction. Any liability on the part of Ski-Verleih Schneider beyond that relating to the booking is hereby excluded.
The place of jurisdiction is Winterberg.
